4.3 Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit any of the material related to AXA Engineers’ proprietary methodologies and tools, except as expressly permitted through written agreement or as specified in the terms of engagement.

5. Payment Terms

5.1 Fees: Fees for our design, drafting, and any additional services will be provided during the service agreement process. You agree to pay all fees according to the payment terms presented to you.

5.2 Billing Information: AXA Engineers will provide detailed billing information in the contract and invoices provided to you for payment. This ensures transparency and clarity in the financial aspects of our service agreements.

6. Compliance with Laws

AXA Engineers verpflichtet sich, alle relevanten Gesetze und Vorschriften von Vietnam, Partnerländern und internationalem Recht einzuhalten. Dazu gehört die Einhaltung von Standards für Datenschutz, Rechte an geistigem Eigentum und Berufsethik.

7. Limitation of Liability

AXA Engineers haftet nicht für indirekte, zufällige, spezielle, Folge- oder Strafschäden oder Gewinn- oder Umsatzverluste, unabhängig davon, ob diese direkt oder indirekt entstehen, oder für Datenverluste, Nutzungsverluste, Goodwills oder andere immaterielle Verluste, die sich aus Folgendem ergeben:

• Ihr Zugriff auf oder Ihre Nutzung oder Unfähigkeit, auf die Dienste zuzugreifen oder sie zu nutzen.
• Jeder unbefugte Zugriff, jede unbefugte Nutzung oder Änderung Ihrer Übertragungen oder Inhalte.

8. Indemnification

Sie erklären sich damit einverstanden, AXA Engineers, seine verbundenen Unternehmen und ihre jeweiligen leitenden Angestellten, Direktoren, Mitarbeiter, Vertreter, Lizenzgeber und Lieferanten von allen Ansprüchen, Verlusten, Verbindlichkeiten, Ausgaben, Schäden und Kosten, einschließlich angemessener Anwaltskosten, freizustellen, zu verteidigen und schadlos zu halten, die sich aus oder im Zusammenhang mit Ihrem Verstoß gegen diese Bedingungen oder Ihrer Nutzung der Dienste ergeben.

9. Governing Law

Diese Bedingungen und alle damit verbundenen Streitigkeiten unterliegen den Gesetzen von Vietnam und werden in Übereinstimmung mit diesen ausgelegt, ohne Rücksicht auf die Grundsätze des Kollisionsrechts.

10. Changes to Terms

AXA Engineers reserves the right to modify these Terms at any time. All changes will take effect immediately upon posting and will apply to all access and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

11. Termination

AXA Engineers behält sich das Recht vor, Ihr Konto und Ihren Zugriff auf die Dienste nach eigenem Ermessen und ohne Vorankündigung zu kündigen oder zu sperren, wenn wir der Meinung sind, dass es gegen diese Bedingungen verstößt oder für andere Benutzer, uns, unsere Geschäftspartner oder die Interessen anderer Dritter schädlich ist.
